What Is The 20 Minute Rule In Collin County Court Houses?

Collin County Courts are unique in that the judge will only allow each side 20 minutes to argue their side for temporary hearings.

How Much Does it Cost to File for Divorce in Collin County ?

It depends on which courthouse you file with and where you reside. Assuming you are filing for divorce on your own without a lawyer and representing yourself (which we highly discourage), the cost of filing for divorce in Denton County is: $289 “with waiver to be filed”, $297 “with citation”, $305 “with citation + showcause or TRO”, and $313 “with citation, showcause and TRO”. The cost to file for divorce in Collin County is $299 according to the Collin County District Clerk’s Office.

How Long Does it Take to Get a Divorce in Collin County ?

In both Denton & Collin Counties the minimum waiting period before you can go before a judge after filing for divorce is 60 days.

However, depending on the individual circumstances of your case and any disputes that arise, a final divorce decree can sometimes take years to complete. Do I Have to Wait 60 Days for an Uncontested or Agreed Divorce in Collin County ?

Yes, you still have to wait the mandatory 60 days before you can see a judge when filing for divorce here, even if both parties agree and the divorce is uncontested. However, you will not need to schedule a hearing in Denton County. Just make sure you show up in court very early, as most of the Denton family courts will not hear uncontested cases after 9:00 am.

I Want a Divorce, Can I Remove My Spouse From A Bank Account?

It’s complicated. Denton and Collin County have different rules for this behavior, but only  has Standing Orders. Standing Orders restrict both parties from certain activities, including withdrawing money, restricting access to bank accounts, using credit cards, taking children, etc. Collin County requires a sign a copy of standing orders when filing an original divorce petition.

However, in Denton County there are no Standing Orders so the laws regarding asset restriction are slightly more complex. We strongly suggest you speak to a family attorney experienced with divorce and property division before filing or restricting access to your spouse. There may be negative repercussions for your actions, so consulting with a legal team is highly advised.
